By accessing or using the services provided by Atlasio Media ("we," "us," or "our"), operating under the brand Quevia at quevia.io (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Atlasio Media is located at 30 N Gould St Ste R, Sheridan, WY 82801, United States.

Quevia is a social media management platform that allows users to:

• Connect and manage multiple social media accounts across platforms (X/Twitter, YouTube, LinkedIn, Pinterest, Instagram, Facebook, TikTok, and others).
• Create, schedule, and publish content to connected platforms.
• Generate AI-powered content, images, and articles.
• Track analytics and performance metrics for social media accounts.
• Manage automated workflows for content publishing.
• Participate in an affiliate program to earn commissions.

• You must be at least 16 years old to create an account and use the Service.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4.1 Free and Paid Plans

The Service may offer both free and paid subscription plans. Paid plans provide access to additional features and higher usage limits as described on our pricing page.

4.2 Billing

• All payments are processed securely through Stripe.
• Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on the plan you select.
• Prices are listed in USD unless otherwise specified.
• You authorize us to charge the payment method on file for all applicable fees.

4.3 Cancellation and Refunds

• You may cancel your subscription at any time from your account settings.
• Upon cancellation, you will retain access to paid features until the end of your current billing period.
• Refunds are handled on a case-by-case basis. Contact us at the email provided in Section 14 to request a refund.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights.
• Post or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, or otherwise objectionable.
• Engage in spam, mass unsolicited messaging, or automated abuse of social media platforms.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Attempt to gain unauthorized access to the Service, other accounts, or any related systems or networks.
• Interfere with or disrupt the Service or servers and networks connected to the Service.
• Use the Service to distribute malware, viruses, or other harmful software.
• Scrape, data-mine, or otherwise extract data from the Service without authorization.
• Resell or redistribute the Service without our express written consent.

6.1 Your Content

You retain ownership of all content you create, upload, or publish through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of operating and providing the Service.

6.2 Our Content

The Service, including its design, features, code, branding, logos, and documentation, is owned by Atlasio Media and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without express written permission.

6.3 AI-Generated Content

Content generated using AI features within the Service is provided "as is." You are solely responsible for reviewing, editing, and ensuring the accuracy and appropriateness of AI-generated content before publishing. We make no warranties regarding the accuracy, originality, or suitability of AI-generated output.

The Service integrates with third-party social media platforms. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for:

• Changes to third-party platform APIs, terms, or policies that may affect Service functionality.
• Content moderation decisions made by third-party platforms.
• Suspension or termination of your accounts on third-party platforms.
• Data handling practices of third-party platforms.

You are responsible for complying with the terms of service of all third-party platforms you connect through the Service.

• You may participate in our affiliate program to earn commissions by referring new paying users to the Service.
• Commission rates and payout thresholds are described in the affiliate section of your dashboard.
• We reserve the right to modify commission rates, terms, or eligibility requirements with reasonable notice.
• Fraudulent referrals, self-referrals, or abuse of the program will result in forfeiture of commissions and potential account termination.
• Commissions are paid via bank transfer or PayPal, subject to minimum payout thresholds.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. We do not guarantee any specific results from using the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLASIO MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Atlasio Media and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your Content or any content you publish through the Service.
• Your violation of any third-party rights or applicable laws.

• You may terminate your account at any time by deleting it from your account settings or by contacting us.
• We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice.
• Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.
• Sections 6, 9, 10, 11, and 13 shall survive termination.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts located in Sheridan County, Wyoming.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
